Post-Judgment Modification in South Florida

When Circumstances Change

A final divorce judgment is not always the end of the legal process. Life changes — and when it does, the terms of an existing court order may no longer reflect your current reality. Florida law allows for the modification of certain post-judgment matters when there has been a substantial, material, and unanticipated change in circumstances since the original order was entered.

What Can Be Modified?

Not every term of a divorce judgment is subject to modification, but many of the most significant ones are. Time-sharing schedules and parenting plans can be revisited when a parent's circumstances or a child's needs have meaningfully changed. Child support obligations may be adjusted when income, employment, or the child's expenses have shifted substantially. Alimony can be modified or terminated in response to changes such as remarriage, retirement, or a significant change in either party's financial situation. In cases where a spouse failed to fully disclose assets during the original proceedings, property division may also be subject to reconsideration.
